Terms of Service

These Terms of Service (the “Agreement”) govern your access to and use of Pomoroom (the “Service”). By accessing or using the Service, you agree to be bound by this Agreement.

1. Acceptable Use

Pomoroom is a social pomodoro app designed to help people focus and study together. You agree to use the Service lawfully, respect others, and not:

• Upload or share illegal, harmful, or infringing content;
• Harass, bully, or threaten others, or incite violence or hatred;
• Post sexual content, pornography, or gratuitous nudity;
• Spam, scam, or engage in deceptive or fraudulent activities;
• Reverse engineer or misuse the Service or its infrastructure;
• Violate third‑party rights, including intellectual property;
• Exploit or endanger minors, or promote self‑harm or violence.

2. Eligibility

There is no age requirement to use the Service. You agree to provide accurate information and keep it updated.

3. Account Management

You are responsible for safeguarding your account credentials and for all activities under your account. You may delete your account at any time in Settings. Account deletion removes your data as described in our Privacy Policy.

4. Ownership and License

Pomoroom and its licensors retain all rights in the Service and related intellectual property. Subject to this Agreement, we grant you a personal, limited, revocable, non‑transferable license to use the Service for personal, non‑commercial purposes.

5. User Content

You retain ownership of content you submit. You grant Pomoroom a non‑exclusive, worldwide, royalty‑free license to host, store, process, and display your content solely to provide and operate the Service. You are responsible for your content and for ensuring it does not violate laws or rights of others.

6. Community Rules

To keep Pomoroom safe and productive, the following are not allowed:

• Sexual content, pornography, or gratuitous nudity;
• Hate speech or discriminatory content;
• Gratuitous or celebratory violence;
• Spam, scams, phishing, or deceptive metadata;
• Copyright infringement or unlawful sharing of content;
• Impersonation or misrepresentation;
• Bullying, harassment, or doxxing;
• Exploitation or endangerment of minors;
• Cheating, fraud, or other dishonest behavior.

7. Purchases, Subscriptions, and Trials

Purchases on iOS are processed by Apple. Prices are displayed in your local currency as provided by the App Store and may vary by region.

Available Products

• Lifetime (Product ID: pomo_74.99_lifetime): One‑time purchase.
• Annual (Product ID: pomo_24.99_1y_1w0): 1‑year subscription with a 1‑week free trial. Auto‑renews unless canceled.
• Monthly (Product ID: pomo_299_1m): 1‑month subscription. Auto‑renews unless canceled.

Auto‑Renewal and Management

Subscriptions automatically renew unless auto‑renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription and turn off auto‑renewal in Settings > [Your Name] > Subscriptionson your device.

Trials, Cancellations, and Refunds

If offered, free trials convert to a paid subscription at the end of the trial unless canceled at least 24 hours before the trial ends. Cancellations take effect at the end of the current billing period. No partial refunds are provided for unused portions. Refunds are processed by Apple pursuant to App Store policies.

8. Service Availability; Changes

The Service is provided on an “as is” and “as available”basis without warranties of any kind. We may change, suspend, or discontinue features at any time.

9. Limitation of Liability

To the maximum extent permitted by law, Pomoroom will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenues, whether incurred directly or indirectly. In all cases, Pomoroom’s aggregate liability shall not exceed the amount you paid, if any, for the Service during the twelve months prior to the event giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Pomoroom and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of the Service or violation of this Agreement.

11. Termination

We may suspend or terminate your access immediately if you violate this Agreement or if required by law. Upon termination, your right to use the Service ceases.

12. Modifications

We may update these Terms from time to time. Material changes will be communicated in‑app or on our website. Continued use constitutes acceptance of the updated Terms.

13. Severability

If any provision is found unenforceable, the remaining provisions will remain in full force and effect.

14. Apple App Store Terms

You acknowledge that this Agreement is between you and Pomoroom only, not Apple Inc. Pomoroom, not Apple, is solely responsible for the app and its content.

• Scope of License: Your license is limited to a non‑transferable license to use the app on Apple‑branded devices you own or control, in accordance with the App Store Terms of Service.
• Maintenance and Support: Pomoroom is responsible for app support. Apple has no obligation to provide any maintenance or support services for the app.
• Warranty: In case of app non‑conformity with any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Product Claims: Pomoroom is responsible for addressing any claims relating to the app or your use of it, including product liability, legal/regulatory compliance, and consumer protection claims.
• Intellectual Property: Pomoroom is responsible for the investigation, defense, settlement, and discharge of any third‑party intellectual property infringement claims.
• Legal Compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third‑Party Beneficiary: Apple and its subsidiaries are third‑ party beneficiaries of this Agreement and may enforce it against you.
• Third‑Party Terms: You must comply with applicable third‑party terms of agreement when using the app, including your wireless data service agreement.
